Judge Refuses To Lower Bobby Shmurda’s $2 Million Bail

Bobby Shmurda will stay in the slammer for a while longer.

A judge Thursday denied Bobby Shmurda’s lawyer’s request to lower the jailed-rapper’s $2 million bail. Judge Larry Stephen ruled that the bail would stay at $2 million, after Shmurda’s lawyer, Ken Montgomery, filed a “habeus corpus” writ that charged that another judge who is presiding over the case abused his authority when he set the bail.

Shmurda’s mother, Leslie Pollard and his aunt, Cherie Williams, who were in court for the bail hearing, blasted Judge Stephen’s bail block.

“There’s no reason not to give him bail, based on the allegations, not based on the fact that he’s Bobby Shmurda,” Shmurda’s mother, Leslie, told Bossip after the hearing.
Shmurda’s aunt agreed.

“It’s expected,” Cherie Williams told Bossip of the judge’s bail decision. “This is a court. You’d think someone had a conscience.”

Shmurda, who has been behind bars since late last year on felony conspiracy, weapons and reckless endangerment charges, was not in court for the hearing Thursday inside Manhattan Criminal Court.

Montgomery said he spoke with reps from Epic Records, and they said they have no plans to put up the money to free Shmurda.

“If Mr. Pollard has access to large sums of cash, he’d be out,” Montgomery said.

Shmurda’s lawyer said his status as a rapper with a record deal fueled Judge James Burke’s decision to set such a high bail. He questioned why Shmurda and Chad “Rowdy Rebel” Marshall had such hefty bail amounts compared to their co-defendants.

Shmurda has no adult criminal convictions and isn’t a flight risk because he doesn’t have a passport, Montgomery said.

“The number set by the court should have some rhyme or reason,” Montgomery told the judge. “The $2 million number has no rational attachment to what he’s accused of.”

But prosecutor Nigel Farinha called Shmurda a “central figure” in GS9’s gun, murder and drug conspiracies. He said Shmurda even shot at his own brother – narrowly missing two small children – when he disrespected him in front of other GS9 members. He said Shmurda’s bail should remain at $2 million, because he is worth about $400,000, and has the means to flee the state if he wanted.

“He is a principal actor in GS9 and a central figure in these conspiracies, all of which are extremely serious,” Farinha said. “I think it ($2 million bail) is a reflection of Mr. Pollard’s role in the conspiracy and access to cash.”

Montgomery said he’d appeal the decision.

Shmurda is due back in court in April.
