Kanye West Sued for Sampling a Song that Didn’t Belong to Him

Someone is Bound to get paid now. The lead singer of a 1970′s music group is suing rapper Kanye West for allegedly using a snippet of his song in the chart-topping single “Bound 2″, released in August of this year. Ricky Spicer was only 12 when he became the lead singer of The Ponderosa Twins Plus One in 1969. According to the suit, the group recorded “Bound” a year after they were united. Now 56, the singer says his voice can be heard in West’s song “Bound 2″, singing the words “falling in love” at least a dozen times in the song. “Mr. Spicer’s voice is sampled exactly as he recorded it and his voice, altered by the Defendants, is also heard several times,” read the 13-page complaint. In response to Spicer’s allegations, Def Jam Records says in the credits for the album “Yeezus,” Bound 2 was licensed through Robinson Music Group and Rhino Entertainment. The defendants are listed as West, Def Jam, Rhino, Roc-A-Fella Records and Universal Music Group. Spicer seeks unspecified damages for common law copyright infringement. The Ponderosa Twins consisted of two sets of twins and Spicer. According to the suit, twins Alfred and Alvin Pelham are dead and Keith and Kirk Gardner are behind bars. Spicer is now the power of attorney for the Gardner twins. The suit, which was filed in a New York Courtroom says Spicer has a copyright on “Bound.” Exemplary damages and whatever further compensation the court thinks is appropriate will be awarded to Spicer if he wins. ~source reason4rhyme
